These Terms of Use is a legally binding agreement made between you as a natural person (“you”, “your” or “user”) and Wergames (“we,” “us” or “our”), concerning your access to and use of Wergames software application for mobile devices (the “App”).

Do not use the App if you do not accept these Terms of Use. If you use the App, you affirmatively accept these Terms of Use.

The App is available only to individuals who are at least 16 years old. Parents and guardians must directly supervise any use of the App by minors.

The App is intended only for your personal non-commercial use. You shall use the App only for the purposes, mentioned above.

Use of Apps

You agree to use the App only for purposes that are permitted by these Terms of Use and any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions. You agree to comply with all local laws and regulations regarding the download, installation and/or use of the App.

You agree that Wergames is not responsible or liable for any content accessed from the App or third-party websites. You agree that you are solely responsible for (and that Wergames has no responsibility to you or to any third party for) your use of the App.

You acknowledge that the App may communicate with our servers from time to time to check for updates to the App, such as bug fixes, patches, enhanced functions, missing plug-ins and new versions. By installing the App, you agree to such automatically requested and received updates. This apps contain material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, audio and video content and graphics. Reproduction is prohibited unless authorised by us in writing.

You agree not to use the App in any way that is unlawful, illegal or unauthorized; is obscene or offensive; is defamatory of any other person; infringes any copyright, database right or trademark of any other person; advocates, promotes or assists any unlawful act such as copyright infringement or computer misuse.

Your use of our apps is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products or information available in our apps meet your specific requirements. You agree that we may stop (permanently or temporarily) providing the App (or any features within the App) to you or to users generally at our sole discretion, without prior notice to you. You agree that if we disable access to the App, you may be prevented from accessing the App or certain features within the App.

We may change or update the App and anything described in it without noticing you. If the need arises, we may suspend access to the App, or close it indefinitely.

You can discontinue using our Services at any time by choosing the relevant option in your iTunes Account Settings. If you decide not to use the App for any reason you should uninstall the App.

Wergames will not be liable to you for any damages of any kind arising from your use or inability to use the App. Our liability for monetary damages for any claims that you may have against us is limited to the amount you actually paid for the App.

Subscriptions

The App is provided on free basis. Once you download he App, you’ll have access to its basic features.

Your account will be charged for renewal within 24-hours prior to the end of the current period and identify the cost of the renewal.

Subscriptions with a free trial period will automatically renew to a paid subscription. Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase.

Payments will be charged to iTunes Account at confirmation of purchase. Any unused portion of a free trial period will be forfeited when the user purchases a subscription.

You may cancel a subscription during its free period via the subscription setting through your iTunes Account. This must be done 24 hours before the end of the subscription period to avoid being charged. Please visit https://support.apple.com/en-us/HT202039

Dispute Resolution

By using the App, you agree that the laws of the Estonian will exclusively govern the construction of our agreement and any dispute of any sort that might arise between you and Wergames. This agreement will not be governed by the conflict of law rules of any jurisdiction or the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. If you are a consumer, the choice of law only applies to the extent that there is no restriction with regard to mandatory rules of the country where you are domiciled or habitually resident.

In the event a dispute arises between you and Wergames, we will use reasonable endeavours to resolve such dispute amicably.
